OELRICH CAMPAIGN RADIO AD VIOLATES FEDERAL AND FLORIDA STATE ELECTION LAWS 


FORMAL COMPLAINTS FILED WITH WSKY AND WKTK RADIO STATIONS, FEDERAL ELECTION COMMISSION, AND FLORIDA DIVISION OF ELECTIONS

 

July 11, 2012.  During the weeks of June 25- July 15th,  2012, candidate Steve Oelrich has been running a 60 second radio ad on stations WSKY and WKTK in Gainesville, first without a disclaimer, and now with one showing he paid for it with his state campaign funds.

Following a complaint to the radio station that his initial ad contained no disclaimer, which is a violation of federal law, Oelrich took down the ad and added a disclaimer, using his state campaign account.

This is another, separate violation of federal election law, which prohibits a federal candidate from the use of corporate funds.  Because his state campaign account accepts corporate funds, Oelrich cannot use these funds in a federal campaign.

He tried to do this illegal action under the false auspices that he was using his state funds to “thank the voters” for their support while he was a State Senator.  Under Florida law, he can use his state account for this purpose if he “withdraws, becomes unopposed, or is eliminated or elected”.  He cannot use it as a qualified candidate for another office.

Through his ad, Oelrich is simply trying to circumvent the state law to advertise and promote his candidacy, while trying to disguise it as a “thank you” to voters.

As a former sheriff, one would expect him to follow not only the letter of the law, but also the spirit of the law.  This radio advertisement clearly shows that he has complete disregard for both.

And considering that he is seeking the higher office of a Congressman, his specious and illegal actions do not reflect well on his competence to hold this office.

I have filed formal complaints with the Federal Elections Commission (FEC) and the Florida Elections Commission, citing the above violations.  Copies of each complaint are attached.
